Basic premise of the case is that the material was classified national security information. The ruling is yet another designed to drive the government away from prosecuting this embarrassing and disturbing espionage case.

I&#039;m pretty sure if the I in AIPAC stood for Iran; and the defendants were prominent Iranian-Americans, these little legal niceties would not be used. Indeed, one suspects the case would already be litigated and finished (with long sentences handed out).

Sigh.
