Edict of the Russian Federation President

In connection with formation of the
Russian Federation Federal Counterintelligence Service, I decree:
1. To confirm the attached Statute on the Russian Federation
Federal Counterintelligence Service.
2. To authorize the director of the Russian Federation
Federal Counterintelligence Service to have five deputy
directors of the Russian Federation Federal Counterintelligence
Service, including one first deputy director and a deputy
director/chief of the Russian Federation Federal
Counterintelligence Service Directorate for the city of Moscow
and Moscow Oblast.
To form within the Russian Federation
Federal Counterintelligence Service a board consisting of 11
individuals.
To establish the numerical strength of personnel in the
management apparatus of the Russian Federation Federal
Counterintelligence Service in the amount of 1,500.
3. To establish the numerical strength of military
servicemen and civilian personnel in the counterintelligence
organs of the Russian Federation in the amount of 75,000 (not
including employees of scientific-research and military-medical
sections and institutions, or personnel engaged in the
operation, security, and maintenance of official buildings and
premises).
4. To authorize the director of the Russian Federation
Federal Counterintelligence Service to make changes to the
structure of the Russian Federation Federal Counterintelligence
Service, taking into account the requirements of edicts and
directives of the Russian Federation president, within the
limits of the established strength of military servicemen and
civilian personnel and budgetary appropriations allocated to the
Service.
5. That the Russian Federation Federal Counterintelligence
Service shall bring departmental normative acts into conformance
with the Statute confirmed by this edict.
6. To acknowledge as no longer in effect Edict No. 42 of the
Russian Federation President, dated 24 January 1992 "On
Formation of the Russian Federation Security Ministry," with
subsequent amendments to it.
7. That this decree enters into force as of signature.

Statute On the Russian Federation Federal
Counterintelligence Service
Confirmed by Edict No. 19 of the Russian
Federation President of 5 January 1994
1. The Russian Federation Federal Counterintelligence
Service (Russian FSK) constitutes a central organ of federal
state authority, directs the activity of its subordinate
counterintelligence organs, enterprises, institutions,
organizations, military units, and educational institutions, and
conducts operations to reveal, forestall, and suppress the
subversive intelligence activity of foreign special services and
organizations, unlawful acts of encroachment upon the
constitutional system, sovereignty, territorial integrity, and
defensive capability of the Russian Federation.
The Russian FSK heads a unified system of
counterintelligence
organs of the Russian Federation
(henceforth--counterintelligence organs) operating independently
of the organs of authority of Russian Federation entities, which
includes in addition:
counterintelligence organs in the republics, krays, oblasts,
the autonomous oblast, autonomous okrugs, individual regions of
the Russian Federation, the city of Moscow and Moscow Oblast,
the city of St. Petersburg and Leningrad Oblast (territorial
counterintelligence organs);
military counterintelligence organs in the Russian
Federation
Armed Forces, Russian Federation Border Troops, Internal Troops
of the Russian Federation Ministry of Internal Affairs, and
other forces and military formations of the Russian Federation.
The Russian FSK is the senior operational organ with respect
to Russian Federation Border Troops in matters of operational
investigative activity.
2. The Russian FSK is guided in its activity by the Russian
Federation Constitution, laws of the Russian Federation, other
normative acts of the highest organs of state authority,
international treaties of the Russian Federation, and by this
Statute.
3. The Russian FSK is directly subordinate to the Russian
Federation president.
4. Missions of the counterintelligence organs are:
1) to
reveal, forestall, and suppress subversive intelligence activity
conducted by foreign special services and organizations against
the Russian Federation;
2) to obtain intelligence information on threats to the
security of the Russian Federation;
3) to provide the Russian Federation president information
on
threats to the security of the Russian Federation;
4) to fight terrorism, the illegal turnover of weapons and
narcotics, illegal armed formations, and illegally established
or prohibited public associations encroaching upon the
constitutional system of the Russian Federation;
5) to ensure, within the limits of its jurisdiction, the
safekeeping of state secrets of the Russian Federation;
6) to provide counterintelligence support for operational
protection of the state border of the Russian Federation.
5. Appropriate subdivisions are established within the
Russian FSK to accomplish the missions entrusted to
counterintelligence organs in accordance with established
procedure, as indicated in the appendix.
6. In accordance with Russian Federation legislation, the
Russian FSK:
1) organizes execution of the laws of the Russian Federation
and other normative acts of the highest organs of state
authority in the counterintelligence organs;
2) participates in the development and implementation of
state programs for guaranteeing the security of the Russian
Federation;
3) organizes and carries out counterintelligence and
operational investigative measures, inquiries on matters
ascribed by law to the jurisdiction of state security organs;
determines procedure for the use to these ends of forces and
assets of the counterintelligence organs;
4) organizes and carries out counterintelligence operations
in revealing, forestalling, and suppressing subversive
intelligence activity on the part of foreign special services
and organizations against the Russian Federation;
5) determines the main orientations and organizes the
intelligence activity of counterintelligence organs in Russian
Federation territory, carries out this activity in interaction
with foreign intelligence organs of the Russian Federation;
6) participates in the development and implementation of
measures to safeguard state secrets, determines the main
orientations of activity of counterintelligence organs in this
sphere; exercises control over the ensurance of safekeeping of
state secrets in ministries and departments, at enterprises, in
institutions and organizations, and in the organs of public
associations, and renders them assistance in developing measures
to safeguard commercial secrets; carries out measures in
accordance with establish procedure related to citizen access to
information which constitutes state secrets;
7) develops and carries out counterintelligence measures to
ensure state security in the Russian Federation Armed Forces,
Russian Federation Border Troops, Internal Troops of the Russian
Federation Ministry of Internal Affairs, and other troops and
military formations of the Russian Federation, as well as in the
organs of internal affairs, federal state police organs, and
customs organs of the Russian Federation;
8) organizes and carries out counterintelligence operations
to reveal, forestall, and suppress terrorist activity inspired
and executed by foreign special services and organizations, as
well as activity directed against representatives of the highest
organs of state authority of the Russian Federation;
9) develops and carries out measures in the fight against
contraband operations and corruption, illegal international
turnover of weapons and narcotic substances, illegally
established armed formations, and illegally established or
prohibited public associations encroaching upon the
constitutional system of the Russian Federation;
10) organizes and directly conducts counterintelligence
measures at facilities of the defense complex, nuclear power
stations, transportation and communications facilities,
facilities comprising the life support of major cities and
industrial centers, other strategic facilities, facilities in
the sphere of space research and high-priority scientific
projects;
11) exercises interaction with ministries, departments, and
social organizations of the Russian Federation, as well as with
foreign special services and organizations, on matters within
its jurisdiction;
12) provides counterintelligence screening for entry into
Russian Federation territory and exit from the Russian
Federation of citizens of the Russian Federation, foreign
citizens, and stateless persons, and for the stay of foreign
citizens and stateless persons in Russian Federation territory;
13) organizes and identifies in Russian Federation territory
radio emissions of emitting radioelectronic systems whose
operation presents a threat to the security of the Russian
Federation, as well as radio emissions of emitting
radioelectronic systems used for unlawful purposes; effects the
recording and centralized registration of radio data and radio
emissions of emitting radioelectronic systems;
14) carries out counterintelligence measures with respect to
operational protection of the state border of the Russian
Federation;
15) organizes and carries out measures for ensuring its own
security, to include counteracting foreign technical
reconnaissance efforts, within the system of counterintelligence
organs;
16) effects, within the limits of its jurisdiction, the
procurement, processing, and analysis of information on threats
to the security of the Russian Federation in the political,
economic, defense, scientific-technical, ecological, and other
spheres, and informs the Russian Federation president in this
regard. Elaborates predictions, based on instructions from the
Russian Federation president, with respect to development of the
internal political and socioeconomic situation in the Russian
Federation; elaborates the strategy of activity of the
counterintelligence organs and proposals for averting and
neutralizing threats to vitally important interests of the
Russian Federation on the part of foreign special services and
organizations;
17) develops, establishes, and operates, independently or in
conjunction with the Russian Federation Ministry of
Communications, Federal Agency for Governmental Communications
and Information of the Russian Federation President, and other
concerned ministries and departments, networks and
communications and information systems supporting the activity
of counterintelligence organs;
18) undertakes measures, on the basis of international
treaties and in conjunction with internal affairs organs,
guaranteeing the security of foreign governments in Russian
Federation territory. Participates in the conduct of measures to
guarantee the security of Russian institutions and citizens
abroad;
19) participates in measures with respect to implementation
of the state of martial law;
20) organizes mobilization readiness and ensures the
mobilization readiness of counterintelligence organs;
21) forms the necessary reserve for mobilization deployment
of counterintelligence organs; determines procedure for the
military registration of reserve officers of counterintelligence
organs; organizes and controls military registration and the
call-up exemption of citizens in the reserve of the Russian
Federation Armed Forces who are working in counterintelligence
organs;
22) coordinates efforts in the organization of local defense
in the counterintelligence organs;
23) establishes information systems, determines procedure in
accordance with Russian Federation legislation for the
accounting, storage, and use of current-operations, archival,
and other materials related to the activity of
counterintelligence organs;
24) organizes and conducts within the limits of its
jurisdiction scientific research on problems of counteracting
the subversive activity of foreign special services and
organizations; conducts experimental design projects; develops
and manufactures special technical means based on its own
scientific production resources and on those of other
enterprises, institutions, and organizations; issues
certificates of quality for certain varieties of special
technical means and, upon decision of the Russian Federation
Government, licenses for certain varieties of activity;
25) conducts operational-technical measures, criminological
and other expert studies and research; when operationally
necessary, produces and uses documents encoding the identity of
responsible officials, the departmental affiliation of sections,
organizations, premises, means of communications, and the
identity of citizens cooperating with counterintelligence organs
on a confidential basis;
26) provides personnel support for counterintelligence
organs; organizes the training, retraining, and qualification
enhancement of personnel at educational institutions within its
jurisdiction, as well as in other educational institutions;
27) discharges military servicemen of counterintelligence
organs to the reserve in accordance with established procedure;
28) provides pensions for military servicemen discharged
from
the federal organs of state security, counterintelligence
organs, Russian Federation Border Troops, formations of federal
organs of governmental communications and information, foreign
intelligence organs and military formations of the Russian
Federation Main Security Directorate, the security service for
the Russian Federation president and his family members;
29) generalizes the practice of application of Russian
Federation legislation in that sphere which falls under the
jurisdiction of counterintelligence organs, and introduces
proposals for its improvement in accordance with established
procedure; participates in the preparation of appropriate draft
normative acts; exercises procedural management of
counterintelligence organs in organizing the legal support for
their activity;
30) determines procedure for the use of actual and code-name
designations in counterintelligence organs; ascribes these
code-name designations in accordance with established procedure;
31) establishes uniform requirements, in accordance with
norms in effect in the Russian Federation, with respect to the
organization of administrative work and records-keeping in the
counterintelligence organs;
32) organizes and carries out efforts with regard to
receiving citizens and examining their proposals, statements,
and grievances on matters falling within the jurisdiction of
counterintelligence organs;
33) effects the licensing and accreditation of
military-medical sections and institutions of
counterintelligence organs in the right to carry out certain
varieties of activity and render services in accordance with
programs of mandatory and voluntary medical insurance of
citizens in the Russian Federation, determines procedure for the
expenditure of financial assets obtained as a result of this
work;
34) determines and implements programs for the medical
support of military servicemen, civilian personnel, citizens
discharged from military service in the federal organs of state
security, counterintelligence organs, Russian Federation Border
Troops, formations of federal organs of governmental
communications and information, foreign intelligence organs,
military formations of the Russian Federation Main Security
Directorate, and the security service for the Russian Federation
president and his family members, in military-medical sections
and institutions, as well as the procedure for conducting
sanitary, hygienic, and epidemic-prevention measures within the
system of counterintelligence organs;
35) accomplishes capital construction and remodeling of
buildings and edifices, housing construction, centralized
financing, provision of material-technical support, including
through the use of military and special equipment, armament, and
other varieties of material-technical assets of the
counterintelligence organs; monitors the use of monetary and
material-technical assets.
7. The Russian FSK is headed by the director of the Russian
Federation Federal Counterintelligence Service, who is appointed
to and discharged from his position by the Russian Federation
president.
The director of the Russian Federation Federal
Counterintelligence Service:
1) bears personal responsibility for the execution of tasks
and obligations entrusted to the Russian FSK;
2) organizes the operation of the Russian FSK, directs the
activity of counterintelligence organs, forms boards within
these organs and approves their composition, is the senior
operations chief in matters of operational-investigations
activity with respect to the Russian Federation Border Troops,
establishes the authority of responsible officials of the
Russian FSK and counterintelligence organs with respect to the
independent resolution of operational, organizational,
staff-structure, personnel, financial, production- managerial,
and other issues;
3) represents the Russian FSK in mutual relations with the
organs of legislative, executive, and judicial power of the
Russian Federation;
4) issues normative acts with the aim of exercising law-
enforcement, special, and informational functions based on and
in fulfillment of existing Russian Federation legislation, this
Statute, and directives of the Russian Federation president, and
sets up inspections to verify compliance with them; in necessary
instances, adopts normative acts jointly, or upon coordination
with other Russian Federation ministries and departments;
5) rescinds the normative acts of heads of
counterintelligence organs which are in contravention of Russian
Federation legislation;
6) introduces for examination by the Russian Federation
president, in accordance with established procedure, draft
normative acts and proposals with respect to improving Russian
Federation legislation in the sphere of guaranteeing the
security of the Russian Federation;
7) presents to the Russian Federation president for
confirmation proposals on the personnel strength of
counterintelligence organs of the Russian Federation (not
including employees of scientific- research and military-medical
sections and institutions, or personnel engaged in the
operation, security, and maintenance of official buildings and
premises of the counterintelligence organs);
8) submits for examination by the Russian Federation
president proposals on including military positions of the
system of counterintelligence organs within the Uniform Listing
of Military Occupational Specialties, staffed by top-ranking
officers;
9) presents to the Russian Federation president for
confirmation the listing of military positions to be staffed in
counterintelligence organs by colonels (captains 1st rank);
10) submits for examination by the Russian Federation
president proposals on the appointment (discharge) of military
servicemen of counterintelligence organs to (from) positions for
which authorization documents stipulate top military ranks, on
awarding these individuals the top military ranks of the officer
corps, and on discharging them from military service;
11) submits for examination by the Russian Federation
president proposals on the conferral of state awards upon
military servicemen, workers, and office employees of
counterintelligence organs, and on awarding them honorary titles;
12) institutes badges for military servicemen, workers, and
office employees of counterintelligence organs; approves
regulations on badges and their depiction;
13) enlists citizens of the Russian Federation for military
service in counterintelligence organs, decides in exceptional
instances to credit them with labor service tenure, and
establishes the procedure for such crediting; effects within the
limits of his authority the appointment of leadership personnel
of subdivisions of the Russian FSK and counterintelligence
organs, and their discharge; discharges military servicemen of
counterintelligence organs from military service, within the
limits of his authority; credits to the tenure of officers
released from service, for pension purposes, their training time
prior to military service, in accordance with established
procedure;
14) makes decisions on extending the term of military
service
for certain servicemen--highly qualified specialists who have
reached the age limit for military service--until age 60;
15) establishes for military servicemen of
counterintelligence organs who have the right to a pension based
on service tenure a monthly bonus above the monetary allowance
in the amount of from 25 to 50 percent of the pension amount
they could be afforded, and determines the terms and procedure
for payment of this bonus;
16) approves the authorized strength of structural
subdivisions of the Russian FSK and counterintelligence organs;
17) decides, in accordance with established procedure,
matters concerning the establishment of enterprises,
institutions, and organizations necessary to support the
activity of counterintelligence organs, and matters concerning
their reorganization and elimination;
18) prescribes the numerical strength of military
servicemen,
civilian personnel of scientific-research and medical-military
sections and institutions of the counterintelligence organs, and
personnel (including military servicemen) involved in the
operation, security, and maintenance of official premises and
buildings, within the limits of appropriations allocated to the
Russian FSK for these purposes;
19) enjoys, with respect to military servicemen of
counterintelligence organs, the entire spectrum of rights as
prescribed by the Disciplinary Regulations of the Russian
Federation Armed Forces;
20) attaches military servicemen of counterintelligence
organs, in accordance with established procedure and while
maintaining their military service status, to organs of state
power, ministries, state committees, federal services, agencies,
inspectorates, and other departments, as well as to
institutions, organizations, and enterprises, regardless of form
of ownership;
21) determines, in accordance with Russian Federation
legislation, the work conditions under which military servicemen
and civilian personnel of the counterintelligence organs may
hold more than one job;
22) authorizes counterintelligence organs to transfer to the
law enforcement organs and special services of foreign states
secret operational information, special items and their
applicable technical documentation, within the jurisdictional
limits of the Russian FSK, and upon the accomplishment of
certain coordinating actions;
23) authorizes military servicemen, workers, and office
employees of counterintelligence organs to travel outside the
Russian Federation in accordance with established procedure;
24) is the manager of credits allocated to finance the
system
of counterintelligence organs, including hard-currency assets;
25) exercises other authority in accordance with Russian
Federation legislation.
8. A board is formed within the Russian FSK consisting of
the director of the Russian Federation Federal
Counterintelligence Service (chairman of the board), the first
deputy director, and deputy directors, by virtue of their
position, as well as executive functionaries of the system of
counterintelligence organs.
Except for persons who are members of the board by virtue of
their position, board members are approved by the Russian
Federation president.
The Board of the Russian FSK examines and makes decisions
concerning the most important questions regarding the activity
of counterintelligence organs.
Decisions of the Board of the Russian FSK are adopted by a
majority vote of its members, and are announced in orders signed
by the director of the Russian Federation Federal
Counterintelligence Service.
In the event of disagreement between the director of the
Russian Federation Federal Counterintelligence Service and the
Board of the Russian FSK, the director of the Russian Federation
Federal Counterintelligence Service implements his decision and
reports to the Russian Federation president on the disagreements
that have arisen. Members of the Board of the Russian FSK may
also inform the Russian Federation president as to their views.
Decisions adopted at joint sessions of the Board of the
Russian FSK and other ministries and departments are announced
in joint orders of the Russian FSK and the appropriate
ministries and departments.
9. Control over the activity of the Russian FSK and
counterintelligence organs is exercised by the Russian
Federation president.
10. The Russian FSK is a juridical person, has an actual and
code-name designation, emblem, seal with depiction of the
Russian Federation state symbol along with its designation,
corresponding stamps and seals, and bank accounts, including
hard-currency accounts.
