National Security Bureau


Organic Law of the National Security Bureau

Promulgated by the President of the Republic of China on December 30, 1993
Article1 This law is hereby formulated and set forth in accordance with Article 9 of the "Additional Articles of the Constitution of the Republic of China" and Article 8 of the Organic Law of the National Security Council.
Article2 The National Security Bureau, being a subsidiary organ of the National Security Council, is charged with the overall management of the nation's security and intelligence activities as well as the planning and execution of special missions. The Bureau shall furthermore provide guidance, coordination, and support for the following agencies regarding matters of national security and intelligence: the Military Intelligence Bureau, the Communications Development Office, the Coastal Guard Command, the Military Police Command of the Ministry of National Defense, the National Police Administration under the Ministry of the Interior, and the Bureau of Investigation under the Ministry of Justice.
Article3

The National Security Bureau shall have the following units in charge of the listed pertinent duties:

  1. First Department: International intelligence.
  2. Second Department: Chinese mainland intelligence.
  3. Third Department: Intelligence operations in the Taiwan region.
  4. Fourth Department: The analysis of national strategic intelligence.
  5. Fifth Department: The security of scientific and technological intelligence and communications.
  6. Sixth Department: The development and control of codes and related equipment.
  7. Computer Center: The planning and implementation of information operations and the establishment and management of databanks.
  8. Secretariat: The control and auditing of administrative plans and projects; the evaluation and compilation of work reports; general-type coordination; public relations; custody and use of official seals; handling of official documents; file-keeping; translation, compilation and printing of materials.
  9. General Affairs Office: General affairs, cashier duties, guardsmen services, medical and health care, and other pertinent matters not covered by the other units.
Article4 The National Security Bureau shall have a director general who, either a special rank official or military general, is to oversee bureau affairs. Three deputy director generals shall be appointed to assist the director general, their positions being 14th grade selected- rank officials or lieutenant generals. One of the three may be a person who, although not a regular public functionary, is put on a par with those of 14th grade selected-ranks.
Article5 The National Security Bureau shall have a secretary general and three senior representatives, all being lieutenant generals or 13th or 14th selected-rank officials (rest omitted).
Article6 The National Security Bureau shall have a Personnel Department, to be headed by a director who is a major general or a 12th grade selected-rank official (rest omitted).
Article7 The National Security Bureau shall have an Accounting Department, to be headed by a chief accountant who is a major general or a 12th grade selected-rank official (rest omitted).
Article8 The National Security Bureau shall have a Department of Government Ethics, to be headed by a director with a 12th selected-rank grade (rest omitted).
Article9 The National Security Bureau shall have a Telecommunications Technology Center, to be headed by one of the deputy director generals serving concurrently as center director (rest omitted).
Article10 The National Security Bureau shall have a Training Center, to be headed by a center director who is a major general or a 12th grade selected-rank official (rest omitted).
Article11 The National Security Bureau shall have a Special Service Command Center, to be headed concurrently by the director general (rest omitted).
Article12 Where civil officials of certain ranks and grades have been deemed as eligible for the positions listed in Articles 4 through 11, the appointment categories applicable for the specific posts are to be determined and observed according to Article 8 of the Public Service Personnel Employment Law.

Article15 Various pertinent statutes shall be formulated for the admission of National Security Bureau personnel. In view of the special requirements for intelligence work, the Examination Yuan may be requested to conduct qualifying exams for candidates. How such examinations are to be conducted shall be determined by the said Yuan. Those passing such examinations are to be considered for appointment to security-related posts only.
Article16 The National Security Bureau may, if necessary, commission scholars, experts and academic institutions at home or abroad to conduct research on relevant topics.
Article17 The National Security Bureau may, in order to achieve the required coordination and integration for the nation's security and intelligence work, convene a National Security and Intelligence Conference. With the NSB President presiding, the conference is to be attended by those heading the nation's various pertinent agencies. If necessary, personnel from other related organizations may be invited as non-regular participants.
Article18 The National Security Bureau may convene a National Cryptography Conference to promote integrated control and development of cipher-related matters, including the provision of guidance, coordination, and liaison regarding the maintenance of secrecy about various codes. Chaired by the director general of the NSB, the conference is to be attended by those in charge of the pertinent units of various agencies. Personnel from other related organizations may be invited as non-regular participants if necessary.

Article20 Budgets for the National Security Bureau shall be handled as confidential. Estimates for each budget, when approved behind closed doors at the Legislative Yuan, are incorporated into the budgets of other government agencies. The concerned agencies are to compile and execute these budgets and to audit the closing accounts in a confidential manner.
